Section 95
Registered trade marks 'ALEX', 'VITARAL-G' and 'CANDID' . Interim orders
Oppositions filed within four month but without applications on Form TM-44 seeking extension of time .
Notices of opposition were received within the extendable time - No prejudice or hardship will be caused to the respondent - Applicants for registration can continue to use the trade marks, as have been using till now, under the common law even without registration certificates
HELD Impugned orders of registrar liable to be stayed.
